Holding Deposit
A holding deposit (capped at one week's rent) is generally refundable within 7 days, but a landlord can lawfully retain it if the tenant backs out, fails a Right to Rent check, or provides false/misleading information. If the landlord decides not to proceed, the deposit must be returned.
When a Holding Deposit is NOT Returned (Landlord Keeps It):
• Tenant Withdraws: The tenant decides not to proceed with the tenancy.
• False/Misleading Information: The tenant provides false or misleading information that materially affects their suitability to rent the property (e.g., lying on an application).
• Right to Rent Check Failure: The tenant fails a Right to Rent immigration check.
• Unreasonable Delay: The tenant fails to take all reasonable steps to enter into the tenancy agreement within the agreed deadline (usually 15 days).
